Terms and Conditions for all sales and deliveries.
These Terms and Conditions (“Agreement”) govern the delivery of concrete, screed and related products (“Concrete”) provided by [AMS Build Ltd] (“Supplier”, “We”, “Our”) to the customer (“Customer”, “You”, “Your”) at the specified delivery location. By placing an order you agree to these Terms and Conditions.
1. Order Confirmation
All orders must be confirmed by the Customer, including the type and quantity of Concrete, the delivery location, and the delivery time. The Customer is responsible for ensuring the accuracy of all details provided, including the dimensions, volume, and specifications of the Concrete required.

2. Delivery and Scheduling
Delivery times are estimates and are subject to change based on weather, traffic, and other factors beyond the Supplier’s control. The Customer must ensure that the delivery site is accessible to the Supplier’s delivery vehicle and that any obstructions (e.g., low bridges, narrow roads) are communicated in advance. If the Customer fails to make the site accessible at the time of delivery, additional fees may be charged for re-delivery or delayed services.
2.2 Deliveries or work carried out by AMS Build Ltd outside normal business hours (Monday-Friday, 7:00- 16:00) will be subject to an additional out-of-hours charge at the company’s prevailing rate.
3. Delivery Site Requirements
The delivery site must be level, stable, and capable of supporting the delivery vehicle and any associated equipment. The Customer must provide clear instructions for where the Concrete and or other products should be delivered (e.g., specific location on the site) to the office and the driver. The Customer is responsible for ensuring that the area is safe for the delivery driver and that there is proper signage or lighting, if necessary.
3.1 Deliveries are made kerbside unless agreed to at the time of booking. If the Driver is required to leave the Public Highway and drive onto private property, this will be done at the sole responsibility of the over signed, who will become fully responsible for any consequential damage that may occur to the said property or any part thereof. If the event of the vehicle becoming stuck or bogged down AMS Build Ltd will also look to the over signed for reimbursement of all vehicles recover cost, repair of damage caused to our vehicle and loss of earnings whilst out of use.
4. Payment Terms
Full payment is due before or upon delivery, unless otherwise agreed in writing.
Payments must be made via the method specified by the Supplier (e.g., bank transfer, card payment). Late payments may incur a late fee as specified in the invoice.
4.1 All goods shall remain with the company until payment has been made in full. The company reserves the right to repossess goods not paid for in full, and any damage or costs arising from recovery shall remain the customer’s liability.
5. Cancellation and Rescheduling
Cancellations or rescheduling must be made at least 24 hours before the scheduled delivery time. If the Customer cancels or reschedules outside this period will incur a charge of 40% of the quoted booking value.
5.1 If a load has already been batched or in transit, the customer is liable for the full invoice value.
5.2 Cancellations by the company will not liability other than refund of any prepayments for undelivered goods.
6. Waiting times & wasted journeys
Waiting times that exceed the allocated slot of 45 minutes per load may be charged at the company’s prevailing hourly rate.
7. Concrete Quality and Specifications
The Supplier will deliver Concrete in the agreed-upon specifications (e.g., mix & volume).
Any complaints regarding the quality of the Concrete must be made within 24 after delivery, subject to change depending on the time of year. The Supplier will not be liable for any complaints made after this period. The Supplier is not responsible for any issues arising from improper handling or usage of the Concrete once it has been delivered to the site. Additional of extra water will reduce the strength and durability of the concrete mix.
8. Testing & Complaints
Testing of concrete should be made in accordance with BS 5328. The Driver must be informed when a test is to be earned out in order that compliance procedures may be checked. Unless the procedure is followed the company cannot accept responsibility for any defective concrete.
8.1 Shortages or issues must be reported immediately to the driver and AMS Build Ltd office via telephone within 30 minutes of the delivery. Where a complaint is made, the following procedures will be followed, customer will receive a follow up email reiterating the discussion with a reference number. Failure to comply with the procedure will result in a invalid claim.
9. Liability and Indemnification
The Supplier is not responsible for any damage to property, injury, or other losses that occur during delivery, unless caused by the Supplier’s negligence or wilful misconduct. The Customer agrees to indemnify and hold the Supplier harmless from any claims, damages, or liabilities arising from the delivery or use of the Concrete and any other product delivered.
10. Force Majeure
The Supplier is not liable for any failure to deliver or delay in delivery caused by events beyond its control, including but not limited to natural disasters, strikes, or accidents.
11. Ownership and Risk
The ownership and risk of the Concrete and or aggregate pass to the Customer once it has been delivered to the site. The Supplier retains ownership of any equipment or materials used during the delivery process until full payment is received.
11.1 Price lists and advertising material are for general guidance only and do not form part of any contract between the company and customer unless agreed otherwise.
11.2 Quotations will remain valid for 21 days unless other stated and are subject to written confirmation.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of England and Scotland.
13. Amendments
The Supplier reserves the right to amend or update these Terms and Conditions at any time. Any amendments will be effective immediately upon posting to the Supplier’s website or as otherwise communicated to the Customer.
